Industrial sample is a result of creative human activity in sphere of artistic design. Industrial samples may include shape, image, color, or any combination thereof which determine appearance of an industrial product and are intended to satisfy esthetic and ergonomic needs.
Ownership of an industrial sample is certified by patent. Duration of a patent for industrial sample is 10 years; it may be prolonged upon application from the patent holder, but for a period not exceeding five years.
It is worth noting that industrial sample patent protects only the object’s appearance (for example, electrical coffeemaker design, bottle shape, automobile appearance).
To procure a patent of Ukraine for an industrial sample, an application must be filed with the Patent Office of Ukraine (Ukrpatent). The application includes a set of duly executed documents. To procure patent in any foreign country, an applicant must file an application with the patent office of a specific country or file an international application.
