Registration in Ukraine of copyrights and related rights

Ukrainian law protects personal non-proprietary and proprietary rights of author and his legal successors which involve creation and use of works of science, literature, and art (copyright) and performer, phonogram and videogram producer, and broadcasting rights (related rights).
Duration of copyright: a copyright begins at the moment a work was created, continues for the duration of author’s life, and expires in seventy years beginning from the 1st of January of the year which follows the year of death of author or the last coauthor who outlived all other coauthors.
As a rule, registration helps inform the public about existence and ownership of copyright, makes identification of true copyright holder easier in the event of a dispute, and gives copyright holder procedural advantages when defending copyright in court. Usually, right of a work may be registered by persons who own copyright or any exclusive right to said work at any time during copyright protection period, and is carried out by a special agency which issues an appropriate document.
Copyright protection covers published and unpublished, finished and unfinished works.
Copyright to a certain work occurs as a result of creation of said work. Therefore, every author who creates a work automatically accrues ownership of this work. Ukraine, as other countries, has a copyright registration mechanism in place. The registration is carried out by a special authorized agency called Ukrainian Copyright and Related Rights Agency (UCRRA) which maintains author database, registers their works, and issues copyright certificates.
To register copyright and procure copyright certificate the author must file a duly completed application with the UCRAA. The application will then be reviewed for conformity with applicable requirements, and the agency will decide whether to register copyright and issue a copyright certificate or to deny copyright registration. The average application review timeframe is 2-3 months.
