In Ukraine, registration of domain itself is carried out by Provider who, in turn, bears no responsibility for possible violation of trademark or company name rights.
As of today, Ukrainian law does not regulate directly domain usage rights. The only way of seeking domain name protection is to get protection available to intellectual property. By taking legally competent advantage of both Ukrainian and international laws, you can get the protection you need. A domain name in itself does not represent an intellectual property; however, companies often use their name, name of their product or service, etc. as the domain name when registering a website, and company name or company product or service name does constitute an intellectual property. In this case, you will have a solid and well-protected position when resolving name disputes, either in or out of court.
In Ukraine, the first step in protection of domain names was development and adoption of specific rules of registration of domain name in the top-level domain UA:
- domain name may be registered only upon availability of the certificate of registration of corresponding word trade and service mark effective in Ukraine.
